The WCED’s e-Portal Website is an open platform for sharing educational content relevant to learners in South Africa. We actively encourage learners, educators and other interested parties to make use of the Content for educational purposes. Your use of the WCED’s e-Portal Website as well as any services provided to you on or from or through the e-Portal Website is subject to these Terms of Use. By using this e-Portal Website, you are deemed to have accepted these Terms of Use as a legally binding contract. The Terms of Use incorporate the Copyright and Plagiarism Policy.
The term
- “Content” used herein includes all photos, text, documents, videos, graphics, software, sounds, music, audio-visual combinations and other materials used or accessed via the e-Portal Website;
- “e-Portal Website” used herein refers to this website operated by the WCED;
- “Resource links” used herein includes all references to partner websites to which hyperlinks may be included on the e-Portal Website;
- “User” used herein includes any person or entity accessing the e-Portal Website or using the Content for whatever purpose; and
- “WCED” used herein refers to the Department of Education of the Western Cape Government.
General limitations on the use of the e-Portal Website or Content
The WCED hereby grants you permission to access and use the e-Portal Website and the Content, subject to the conditions contained in the Terms of Use, and you agree that your failure to comply with any of the listed terms will constitute a breach of this agreement.
Users may not:
- download, reproduce, distribute, disseminate, publish or broadcast any portion of the e-Portal Website, or the Content for commercial use, financial gain or non-educational purposes but may do so for educational purposes;
- change or modify or damage any portion of the e-Portal Website, or the Content;
- interfere or circumvent any security or control features of the e-Portal Website, or Content;
- upload or transmit through the e-Portal Website any computer viruses, Trojan horses, worms or anything else designed to interfere with, disrupt or interrupt the normal operating procedures of a computer;
- use the e-Portal Website, or Content, for commercial purposes;
- collect or harvest personal data of any other User, Content supplier or the WCED from the e-Portal Website, or the Content; and
- transmit, distribute, reproduce, broadcast, copy, display, transfer, sell, license or exploit in any manner any portion of the e-Portal Website, or the Content for commercial use, financial gain or non-educational purposes.
If you wish to reproduce or use Content for any non-commercial purpose or in any manner other than as described above, you will need the WCED’s prior written approval. Requests should be directed to Media1.Media1@westerncape.gov.za.
The WCED may, at any time, at its sole discretion, discontinue the e-Portal Website or remove any Content from the Website. By consenting to these Terms of Use you agree to be held solely responsible and liable for any breach of your obligations contained in these Terms of Use. Further, by consenting to these Terms of Use you agree to be held liable for any loss or damage which the WCED may incur or suffer as a result of a breach of your obligations.
General legal conditions
- The WCED shall not be liable for any loss, or damage or indirect or consequential loss arising from the use of the e-Portal Website, or the Content.
- The WCED does not issue any warranties or other similar terms that apply to the use of the e-Portal Website, or the Content. Specifically, the WCED does not warrant that your use of the e-Portal Website or Content will be uninterrupted or error free. Nothing in these Terms of Use shall affect your rights in law to which a User is entitled and in respect of which you cannot contractually alter.
- The WCED will not collect any information in respect of a User, other than the name, surname and email address of any User that registers with the e-Portal Website. The WCED will, however, collect specific data from learners who register with the e-Portal Website, namely: name, surname, email address, school, subject choices and grade.
In consenting to the Terms of Use, you agree that all matters relating to your access to or use of the e-Portal Website and these Terms of Use, including all disputes, will be governed by the laws of the Republic of South Africa, without giving effect to any principles of conflicts of laws, including the United Nations Convention on Contracts for the International Sale of Goods. The WCED reserves the right to change, modify, add, or remove portions of these Terms of Use at any time, and the modified Terms of Use will be effective when posted on the e-Portal Website. Please check this page periodically for any modifications. Your use of the e-Portal Website or the Content following the posting of changes constitutes your acceptance of the changes.
These Terms of Use constitute the whole agreement, including the Copyright and Plagiarism Policy and Terms for Supplying Content. The failure of the WCED to enforce its rights under these Terms of Use is not an indication of a waiver of its rights. In the event that any of the Terms of Use are found to be invalid, unlawful or unenforceable, such terms will be severable from the remaining terms, which will continue to be valid and enforceable. Should a User whish to cancel their registration with the e-Portal Website a message to this effect should be sent to the webmaster via the CONTACT US form.

The e-Portal Website contains hyperlinks to other websites that are not controlled by the WCED and in respect of which the WCED assumes no responsibility. In consenting to the Terms of Use, you are deemed to have agreed that the WCED is not liable for any claim that may arise from the use or accessing of such other websites.

The WCED maintains express Terms for Supplying Content in respect of Content accessible on the e-Portal Website.
Copyright and Plagiarism Policy
The WCED maintains an express Copyright and Plagiarism Policy in respect of Content accessible on the e-Portal Website. The Terms of Use commence from 17 December 2019.
